1. OUR SERVICES

WhaleSniffer is a blockchain data analysis and visualization platform for the Solana network. It enables users to monitor publicly available on-chain wallet activity, view algorithmic wallet scores, and receive alerts based on whale movements. The Services are available globally; users are responsible for compliance with their local laws.

2. INTELLECTUAL PROPERTY

All content, source code, designs, trademarks, and logos are owned by or licensed to Efekan YILDIZ. You may use the Services for personal or internal business purposes only. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

3. USER REPRESENTATIONS

By using the Services, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into this agreement
• You will not use automated tools (bots, scrapers) to access the Services
• You will not use the Services for any illegal or unauthorized purpose
• Your use will comply with all applicable laws and regulations in your jurisdiction

4. FINANCIAL AND DATA DISCLAIMER

WhaleSniffer is a data analysis and visualization tool only. It does NOT provide financial, investment, tax, or legal advice. All data, scores, and alerts are generated algorithmically and are provided strictly for informational purposes. Cryptocurrency markets, including Solana-based tokens and memecoins, are highly volatile and speculative. You are solely responsible for your own investment decisions and any financial losses incurred. Past performance of tracked wallets does not guarantee future results. WhaleSniffer is not a licensed financial advisor, broker, or fiduciary.

5. SUBSCRIPTION PLANS AND BILLING

WhaleSniffer offers two plans:

• Free Plan: Up to 5 tracked wallets, manual scanning only. No charge.
• Pro Plan: Up to 50 tracked wallets, automatic background scanning every 5 minutes. $9.99/month.

Subscriptions are billed monthly through Lemon Squeezy. By subscribing, you authorize recurring monthly charges until you cancel. We reserve the right to change pricing with at least 30 days prior written notice via email or a prominent notice on the website.

6. CANCELLATION POLICY

You may cancel your Pro subscription at any time through your Profile page or via the Lemon Squeezy customer portal. Upon cancellation, your Pro access continues until the end of the current billing period. No further charges will be made after cancellation. Unused time in the billing period is not refunded.

Refund Policy: All sales are final. We do not offer refunds except where required by applicable law. If you are located in the European Union or United Kingdom, you may have a statutory right to a refund within 14 days of initial purchase under consumer protection law. To exercise this right, you must contact us by email at [email protected] before the 14-day period expires, clearly stating your request and the reason. Refund requests submitted after this period or through any other channel will not be processed.

7. PROHIBITED ACTIVITIES

You agree not to:

• Scrape, mine, or systematically extract data without written permission
• Circumvent or interfere with security features
• Use automated tools, bots, spiders, or scrapers
• Attempt unauthorized access to any part of the Services
• Engage in unauthorized framing or linking
• Use the Services to harm, harass, or defraud others

8. FEEDBACK

By submitting feedback, suggestions, or bug reports, you grant us a perpetual, royalty-free license to use and implement such feedback without compensation.

9. SERVICE AVAILABILITY

We reserve the right to modify, suspend, or discontinue the Services at any time. We are not liable for downtime, data loss, or service interruptions caused by technical issues, third-party API failures, or events beyond our control.

10. TERMINATION

We reserve the right to suspend or terminate your account at any time for violations of these Terms or at our sole discretion. Upon termination, your right to access the Services ceases immediately. Active Pro subscriptions will not be refunded upon termination for cause.

11. MODIFICATIONS TO TERMS

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email or site notice. Continued use after the effective date constitutes acceptance of the updated Terms.

12. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT BLOCKCHAIN DATA WILL BE ACCURATE, COMPLETE, OR TIMELY.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR FINANCIAL LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Efekan YILDIZ and WhaleSniffer from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.

15. USER DATA

You are responsible for the accuracy of data you submit. We perform regular backups but are not liable for data loss. See our Privacy Policy for full details.

16. GOVERNING LAW

These Terms are governed by the laws of Turkey. Disputes shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

17. DISPUTE RESOLUTION

Parties agree to attempt informal resolution for at least 30 days by contacting [email protected] before initiating formal proceedings. Unresolved disputes shall be referred to binding arbitration under Turkish Arbitration Law in Istanbul, Turkey.

18. STATUTE OF LIMITATIONS

Any claim arising from use of the Services must be filed within one (1) year of the triggering event. Claims filed after this period are permanently barred.

19. ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receive electronic communications including billing notices, service updates, and policy change notifications.
